TESTING & EVALUATION: The training has been categorized into multiple assignments. Each assignment is followed by an online test. A final passing score of 80% is required for CDITC basic and advanced certifications. The test link will be emailed to you upon completion of the assignments or upon request. The online tests are multiple choice/true or False. All tests are open source/book. A practical scenario based exercise and two research reports are also required. The final exam involves a 4-5 page essay/research paper.

This course introduces the concepts of FTER - Forensic Testimonial Evidence Recovery. The study regiment builds upon and enhances theories and concepts of investigative interviewing covered in the introductory Component Method training. Investigative interviewing discussed as it relates to the process of criminal defense. Practical issues, such as the significance of sworn statements and witness interviewing strategies, are covered, as are the purpose and theory behind Kinesic interviewing, cognitive interviewing, standard law enforcement interviews, and visual imagery techniques. Other practical and theoretical issues relevant to the role of the criminal defense investigator are also addressed. The significance of interviewing to obtain “testimonial evidence” from a forensic perspective is emphasized.

Why do we go to a crime scene days, weeks, or months following an incident? First, the reality is that law enforcement may have left or missed exculpatory evidence at the scene. Second, the scene as reflected in the police reports may not be an accurate representation. The inspection, photography, measurements, and diagrams recovered by a criminal defense investigator serve many purposes in respect to questioning evidence and the claims of witnesses. The criminal defense investigator must focus upon the field of vision and line of sight for those witnesses who were present at the scene. At a minimum the visit should be done to facilitate what is often referred to as the “MY COUSIN VINNY” objective. What do they claim they observed vs. what could they observe based upon the layout and critical features of the scene.
TRAINING OBJECTIVE:
The investigator is introduced to the preliminary virtual site inspection utilizing Google Earth/Maps. The virtual site inspection provides the investigator with the opportunity to examine the scene to engage in a comparative study of the facts and to identify additional leads in advance of the onsite inspection. Of course, due to distance and/or budget the virtual site examination serve as the only opportunity to examine the scene.
1) Examine the scene using Google Earth & Maps
2) Utilize Google Measuring tools and mapping processes to question the claims of witnesses.
3) Generate effective diagrams using satellite and mapping images reflecting location data and relative distances.
4) Generate demonstrative images reflecting the general line of sight and field of vision for witnesses.

As a general rule, the communication between the defendant, defense counsel, and defense counsel agents retained to assist in the defense of a criminal case is protected under the attorney-client privilege and work product doctrine. The extension of the attorney-client privilege to agents of defense counsel is commonly identified as the Kovel Privilege, deriving its name from the decision in the United States V. Kovel, 296 F.2d 918 (2d Cir. 1961). The privilege is subject to all of the customary limitations of the attorney-client privilege. Furthermore, the work-product doctrine must also be understood as it relates to all reports and documentation generated by the investigator operating as an agent of counsel. The work-product protection "shall protect against the disclosure of the mental impressions, conclusions, opinions, or legal theories of an attorney or other representative of a party concerning the litigation." The rules must be understood by the investigator in order to effectively navigate the process. The criminal defense investigator should always consult with the case attorney to discuss their interpretation of the rules as well as their policies.

COURSE DESCRIPTION: The criminal defense investigator is presented with a steady flow of requests to interview witnesses as an agent of defense counsel. The task is often followed by the comment, “I just need you to talk to the witness”. Such commentary suggests that the task is simple and without complication. It is understandable that those lacking in field investigation experience would believe that it is as easy as showing up at the door of a witness or calling them on the phone. Of course, the reality is that the request is more than just one task and it is rarely if ever simple. Locating and establishing contact with a witness can be a problem that is impossible to overcome. Securing an interview is another issue. Difficult and uncooperative witnesses are routinely encountered during the investigative process. Each witness can present a unique problem that will require a unique solution. In addition, the obstacle and level of difficulty can be encountered on multiple levels.

The CDITC demands learning participants and partners to provide
detailed answers reflecting unique individual thoughts. Teams may be formed to complete projects and
facilitate scenario based learning. Discussion
among participants may be encouraged for open books assignments. However, answers are not to
be shared and must reflect the participant’s unique understanding and thoughts.
Essay submissions that are identical or substantially similar to another
participant’s work product will be disqualified. While
group discussion and problem solving is encouraged, learning to think and work
independently is part of the training and educational process. Cheating or
plagiarism in any form is considered a serious violation and may result in
disciplinary action.
